Hiring one employee in another state can appear to be primarily a recruiting decision. It can also introduce new considerations involving payroll registrations, workers’ compensation, employment practices, notices, HR administration and other state-specific requirements.

Legacy Employer Concepts helps employers compare Professional Employer Organization options with the company’s full geographic footprint in mind.

The Multi-State PEO Readiness Review considers where employees currently work, where the organization expects to hire, payroll and employee classifications, workers’ compensation requirements, HR support needs, available technology, employee-benefit priorities and whether the existing provider can effectively support the company’s future footprint.

The review is particularly relevant for small and mid-sized businesses that are expanding beyond the state in which their original administrative processes were created.

National Association of Professional Employer Organizations (NAPEO) research released in 2025 found that more than 230,000 U.S. businesses partner with PEOs. PEO clients operate in every state, illustrating the role PEOs can play for employers with increasingly distributed workforces.

“Multi-state capability is something that should be discussed before expansion instead of discovered after the company has already hired,” Arthur said. “The right question is not simply whether a provider operates in another state. It is whether that provider is a good fit for the entire business.”

Different PEOs can have different geographic capabilities, workers’ compensation appetites, benefit structures, service models and technology. A provider that fits a company operating from one location may not necessarily remain the strongest match as the organization expands.

Legacy Employer Concepts serves as a broker resource that allows employers to compare multiple PEO options instead of attempting to research providers individually.

The brokerage says a multi-state review does not automatically mean a business needs to replace its current provider. In some cases, the existing structure may already support expansion effectively. In others, an advance comparison can identify gaps before they become operational problems.
